The cellular handset market is increasingly dominated by devices with functionality far exceeding the earlier generation of “feature phones”: with this surge in functionality comes increased competition between component manufacturers. Intellectual property (and patents in particular) has become a key arena in the struggle for market advantage over competitors. While parts of the media have declared the “Smartphone Wars” over, for patent holders, operating companies and device manufacturers the Wars have barely begun. Courts and border agencies worldwide have been inundated with IPR lawsuits as these companies seek to consolidate their market positions.
